Fire And Prosecute Jackbooted Thugs V

So, let's recap after a long weekend:

Drop all charges against this nurse.
Done.

Fire the officer(s) who arrested her, for cause, without benefits or pension.
Working on it. Currently suspended (with pay) pending criminal investigation, at least for the two douchebadges most responsible.

Refer them for prosecution for false arrest, kidnapping, and violation of civil rights.
DA is on it.

Demote his/her/their supervisors.
Lt. Jackboots Dickhead is not suspended, but he's under a good bit of scrutiny. So no.

Make your entire department go through mandatory re-training on why this is recockulous.
Done.

Revoke all sovereign immunity, so the nurse, hospital, and all patients affected can sue the officer(s) in question, the city, and the SLPD, for whatever exorbitant civil damages multiple juries think are justified and fair. Something in the mid nine figure range looks appropriate based on the video.
Nope.

Require your mayor, your police chief, the watch commander, and the supervising sergeant(s) of the officer(s) in question make a full, forthright, rapid, and public apology, on air and in writing, to that nurse, her co-workers, the patients, hospital, staff, and citizens of SLC for this egregious violation and badge-happy horseshit.
Done, for the most part.
They all dove on this grenade with remarkable unanimity and speed.
Which bodes poorly for the responsible parties in the long run.

So far, Salt Lake City PD and city management are 3/7, with two more pending, one iffy, and no action on one item.

Not bad for getting your entire city dragged through shit on its face for the actions of two badged assholes.

So it's back to the drafting table for me.
Half-assed compliance will not be given full credit.

Oh, and extra icing on the cake:

1) Detective Jackboots' second job, driving an ambulance? The one where he was going to "bring transients to this hospital, and take his 'good patients' to other hospitals"? That ambulance company has shit-canned him as well over this incident. Karma's a bitch with sharp, pointy fangs, @$$hole.

2) Since the entire incident constitutes an illegal detention and unlawful arrest, Det. Jackboots Payne is facing an additional complication if/when this goes to prosecution:

In Utah, as in a number of other states, assault on a health care provider is chargeable as a third-degree felony too. (Under which "substantial bodily injury" is defined as "pain". Pretty sure getting manhandled and cuffed up unlawfully, based on the video evidence, supports that count.)

Here's Your Multi-Day Warning Message

                                (This embiggens.)

Read it.
Heed it.
Don't be a dipshit.
Not a single fuck shall be given for slackers and snowflakes.
(The US V.I. and PR are about to get hammered. Then FL. Then...??)

FL Hurricane warning/SOE msg:
Governor Rick Scott declared a state of emergency in all of Florida’s 67 counties in response to Hurricane Irma Monday. The governor wants to ensure local governments have ample time, resources, and flexibility to get prepared.
“Hurricane Irma is a major and life-threatening storm and Florida must be prepared,” said Governor Scott. “I have continued to be briefed by the Florida Division of Emergency Management on Hurricane Irma and current forecast models have Florida in Irma’s path – potentially impacting millions of Floridians.
Today, given these forecasts and the intensity of this storm, I have declared a state of emergency for every county in Florida to make certain that state, federal and local governments are able to work together and make sure resources are dispersed to local communities as we get prepared for this storm.
And the downstream Cone Of Uncertainty for Irma stretches from Houston TX to Wilmington NC. It's isn't going to disappear magically after it hits the FL Keys. Please, get your shit together ASAP if you're in the downstream (those of you not already bailing out from Harvey, anyways).

Those folks sent in an update of their own:

Point: Counterpoint

                 "Jane, you ignorant slut!"

Those of a certain age (this point will be important - keep your thumb in that spot) will remember a regular, and long-dead feature on SeeBS' 60 Minutes during the 1970s.

Reliably rabid Left-wing columnist of the era Shana Alexander, and reliably rabid right-wing columnist Jack Kilpatrick, would be tossed a cause du jour, which they would then fight over for about 60 seconds apiece, like terriers on a rat.

Mocked epically and hilariously on fledgling late-night show Saturday Night Live with Dan Aykroyd portraying Jack Kilpatrick, whose every episode's response to liberal Jane began, "Jane, you ignorant slut!"

Well, yesterday or so, for the benefit of those of you who don't visit there, this discussion, entitled Great Boomer Moments popped up over at WRSA, headed by this meme:

With my own meme-making skills still wet behind the ears, I can nonetheless recognize when someone has short-sheeted that argument just a tad. In a group originally numbering some 74M folks, the only thing one can say about Baby Boomers as a generation, is that they're all Boomers. Anything else is prima facie so logically inaccurate and truth-free that further exposition on the point is wildly inaccurate ad absurdum.
So I responded appropriately and far more accurately:

Touche', pussycat!
Equal time for opposing views. Sauce for the gander. And all that.

(Be in no confusion: website honcho CA and I agree far more than we'll ever disagree, and he runs a strict comments policy over there: Anything goes.) But I figured balance had been restored to the Force, and I toddled off to work for the evening.

And then Team Fucktard's champion came in and shit the bed, and got his stupid all over everything; to wit:
Another person who has all the ideas for OTHERS to try (all your B.S. about what ‘not’ to do for the lib’s march to D.C.- and you didn’t do SQUAT). And you have no responsibility for the current state of affairs in this country; you are a VICTIM because of your age! I guess you’re another who is pretending to have just turned 18 last November.
I didn’t vote for Soc Security (or Clinton, or Obama, but don’t let facts get in the way of your sniveling). Did you vote for Soc Sec? No? You were not of voting age when FDR was president either? But I get the blame and you don’t? OK But I bet you have refused to participate in soc sec. so you are less responsible for that cluster than those older than you. Right? [But we all know you didn’t/can’t/won’t try to refuse to pay into Soc Sec.]
But you have ZERO responsibility, because you have a “blog” and that means you’re ‘doing something’. Oooooh Aaaahhhh! BFD
BTW, didn’t you write somewhere that you live in Kalifornia? Arguably the most socialist, debt-ridden state in the union?
Hopefully I am mistaken about your residence; because only an extreme hypocrite would cast stones at people in other states who have not allowed that level of insanity to take hold in their states?
But if I am not mistaken in that:
You’re just a blow hard.
And I can see why T-fat despises your ass.

Now, look here. I'm as gentle a kitten as can be, I swear, as any perusal of this blog's pages will attest. But if you're going to walk in, shove your finger down your throat, and throw up the whole bottle of Thunderbird you drank to come up with the impetus to write such a post, I'm going to get a bar mop, grab you by the stacking swivel, and set to cleaning up your chin a little. So here, for your amusement and entertainment, is the rejoinder to that little puddle of puke (and also, because it's a three-day weekend, and I see no reason to work very hard for blog fodder today. And hell, I was pretty proud of it if I do say so.):

Gosh, yeah, you caught me, I didn’t hop on a jet to fly 3000 miles to fuck up 23 whiny crybabies walking through the VA woods.
You were there though, right?
No?
Then STFU, and go apply some more butthurt cream.
CA’s post on the topic invited thoughts; I shared mine. And you brought…what, exactly? Yeah, thought so.

Now please, do go on about how I have any responsibility for the state of affairs in this country.
Show your work.

To date, I’m guilty of having my paychecks hijacked since the age of 14 for a “benefit” that I’ll never collect: it goes bankrupt before I get there.
I’ve voted against the shit I could, every time I’ve could, at every level, volunteered for campaigns for people and measures to stop it, and donated time, money, and effort.
But I can’t outdo the work of the fucked up children of the “Greatest generation”, who started as hippies, became college professors and rock stars, and have been undermining the country pretty much non-stop since decades before I was born.

The earliest actual boomers could vote for a president was the year Nixon was elected (i.e. someone born in 1945, the first year of the baby Boom, wouldn’t be 21 – the legal voting age – until 1966); other than Nixon’s fuck-ups which gave us one-term Carter, then 12 years of Reagan/Bush,

and a peacetime boom that went unhindered into 1999, when Democrats in Congress engineered the housing bubble. But it wasn’t until boomer’s kids could vote that we got Clinton, just as noted.

And whoinhell blamed you for Social Security? Are you 105 years old??? As I noted, correctly, that bullshit was more residue of the “greatest generation” (of theft from their children), and their fathers, for stealing from their grandkids, taking SS payouts that were paid for after contributing about $1 into the system for every $1000 they pulled out before they died off. So pull your head out and read what I wrote, instead of imagining what I didn’t write.

I never claimed victimhood, just placed the blame where it was:
the Progressive fucktards who voted in the 16th, 17th, 18th, and 19th Amendments, then piled on by giving us President Fuck Dem Republicans for four terms.
Blaming the boomers for what happened 25-40 years prior, exactly as I noted, is epic horseshit.

“Refuse to pay into Social Security?” So you’re a marijuana user, or unaware that the money for that is removed before I’m paid.
If you’ve sussed out the unicorn you described, please, show your work.

So I have zero responsibility, because I have zero responsibility.
Didn’t vote for any of the fucktard nonsense, voted against it every chance I had, did everything I could. I am one person. I’m not a generation. I’m me. You’re you. That’s how it works. Group punishment only goes in kindergarten and boot camp. As a nation, we’ll all pay for the majority’s fuck-ups, but suffering because the bus driver drove you off the cliff doesn’t become your fault because you were dragged along for the ride, and some folks are doing their damnedest to GTFO the bus before it tips.
So suck it up, buttercup.

And I’ve written, not somewhere, but frequently, that I do in fact live in Kalifrutopia. Born here, raised here, probably die here. We are, indeed, the most debt-ridden state in the nation, owing to our size and population. Most socialist? Eat shit and die.

I grew up with Governor Reagan – a true communist, no?
The minute I was old enough I dumped Moonbeam the first time. After that, I – and gazillions of my friends and neighbors - put in Republican governors who ran the state wisely and well. Oh, and a President who used to be our governor, a coupla times, IIRC.

And if you look at that meme above, I cast no such stones at anyone in other states for not letting them go to shit.

But since you asked…

The fly in the ointment here was overwhelmingly not native Californians, but rather your toothless, banjo-playing kinfolk who moved here from liberal hives by the Beverly Hillbilly Okie carload, and democrat-stronghold trailer-parks from hell to breakfast, because just like Texas (now, for the moment #2) CA then (1945- ) had the biggest, most booming economy in the country. We built ships, cars, airplanes, all the parts and sub-assemblies for same, drilled and refined oil, fed the world, made 99% of the world’s TV and movies and records (records: what they called CDs and iTunes back when people here worked for a living), and created Silicon Valley.

And over time, ass-loads of liberal fucktards from NYFC, Massholes from Boston, and all the trailer-park trash on the planet flocked here.

And helpfully, besides Teddy Kennedy fucking the country over with the Immigration Act of 1965, and 98 other senators and 400 other congressman looking the other way, nobody saw a problem with the flood of wetbacks who moved in, and started staying here – instead of picking lettuce for 4 months, and scampering back to mamacita’s house in Mehico to live on that cash the other 8 months. And they voted. Like Daley Democrats, including the dead. Hippies swarmed the Bay Area first, dragging Frisco down into the sewer it became by the 1970s. And decent people, who’d lived and worked here for generations, died off, and their kids watched their homes turned into shitville in a generation or two.

(Read anything Victor Davis Hanson has written about this in the last twenty years; he’s a third-generation farmer/rancher in the Central Valley, besides a world-class Stanford historian, and watched his locale go from mainstream America to Jalisco by way of Beirut in a generation.)
The same thing happened to L.A. next, and by the 1990s, the chickenshits who came here from somewhere else got the fuck out, because CA wasn’t home, just a paycheck, and the rats and fleas had fucked it up for everyone.

(And you and countless ignorant assholes refer to them as Californians. Ha! They’re as Californian as our recalled governor, Gray Davis; or Nancy Pelosi; or Barbara Boxer. Google/Wikipedia them, and tell me where they were from. Hint: not here.)

Even our homegrown asstards couldn’t get a word in edgewise until the rot was well-and truly into the roots. We wouldn’t have had Moonbeam the first disastrous time, nor Diane Feinswein, nor countless other assholes, until things were fucked up enough that their tribes could vote them back into power. 1974/5 was the tipping point, in case you wondered, and even then, they had a run for their money until they finally imported enough migras and chased out enough weak-kneed workerbees to rule the demographics.

So now we’ve got the migras in a conga line to infinity stretching from San Diego to Tierra Del Fuego and Shanghai, and your kinfolks and their spawn, and you’ve got the chickenshits who’d rather run than fight; by all means, keep them, but first ask folks in CO and OR and WA how that’s working out for them. TX is purpling up nicely too. You’ve got the faux Californians, and the ones who think you can run away from the problem. Where do you run to next? And your toothless, banjo-playing kinfolk are still here, still in a trailer, and they have nine kids from three baby daddies, and the ones old enough to move out live in tarps along the freeways and drainage canals.

You’ve imported literally millions of your biggest, goofiest, most worthless shitbags to us, just like Mexico has. They weren’t born here. They just can’t go any further west, and the weather’s nicer.

But the most socialist? Oh FUCK no. Massholes from Bahstun are miles ahead of us there, and everyone in NYFC who’s fucked over the PR of New Yawk. And Chicongo has dragged Illinois under, Detroitistan looks like Beirut in every way, Minnesota has been batshit crazy back to being the only D state against Reagan, Baltimorons have ruined Maryland, and the open sewer of NJ are all shitastically worse than here, as are RI and CT. We might barely make tenth on the list, but only because District of Communism isn’t a state, just a rump territory, and only because WA and OR are worse, but less important, nationally, though both are far lefter in every way than CA.

Take a look at the electoral map again, smart guy:
outside the coastal Blue Hives, most folks in CA are still politically to the right of Attila the Hun. (Compare 2016 to the earlier map)

Personally, given the nuclear codes for five minutes, I’d nuke five cities (three in CA and two in Mexico), and after that, the rest of CA would be redder than a sunburned pig’s ass for a century, and the most liberal candidate we elected at any level would call Limbaugh and Hannity soft on socialism. And we’d have the radioactive mess cleaned up in 6 months, sell it to Mexico as baby food at a net profit, and have the whole CA jobs and production machine ticking like a Swiss watch again in about a year.
And among the people I know here, I’m a mainstream moderate in that view.

(For a bonus, without those 55 CA electoral votes anymore, you’d never see another Democrat in the White House this side of 2200 A.D. You’re welcome.)

Ask me about secession then.

And frankly, I’ve paid my dues. I love it here, despite the shitheads in the state capitol. Just like people in 49 other states feel about their homes. Probably even you. They’re about to go epically broke here, the wheels will come off the wagon like Venezuela and every other attempt at socialism gone inevitably amok, and I’m going to get to watch the CA equivalent of Moscow 1990, and watch the statues of Lenin and Marx here get pulled down, by necessity, if not torch and pitchfork mob. I have a torch and a pitchfork, and a healthy list of folks to hang as decorations from the city gates, come the day. Hear me, God.

I have no idea how t-Fat feels about my ass, if he has any opinion whatsoever. Why you’d drag him into your tawdry whining I have no idea.
Most folks worth the time know how to make their own arguments without outside help.

But if, despite those realities, and nothing but the rash around your ass and a sagging diaperload of ad hominem, you want to suck t-Fat’s ass, despite the fact that even he’s throttled the shit-flinging way the fuck back lately, and actually makes a solid point now and again, it’s your tantrum.

There’s always room for a guy to be all they can be, and if you want to be That Guy, go ahead on; CA runs an open comments section here, so there’s nothing standing between you and the That Guy trophy but a few more contributions as mindless and butthurtedly worthless than that last one.
Just get out your crayon and a piece of tape, and fill your name out in the blank spot below.

So, did you really want to talk about the weather, or just make chit-chat?

I think this is yours…

                                                                 _______

Feel free to fact-check any of that you like, and have at it in comments.
Oh, if I should have issued a keyboard/beverage alert, my apologies.
And I do have one regret:
I didn't open the reply with
                                       "Jane, you ignorant slut!"

A Word To The Wise

h/t Kenny

Floating around on Facebook for the last few weeks...
“If you are paid $25.00 an hour to show up to a rally to “counter” the other party using physical force and violence, you are not a “counter protestor.” You are a mercenary. There is no need for further debate on this. You were paid to attack someone you don’t know for reasons that you couldn’t care enough about to go there for free. You did your “job” and collected your check and your reimbursement of expenses. You’re a mercenary.
Not a Patriot. Not a Social Justice Warrior. Not a Defender of Freedom or Liberty. Not an upholder of Truth or Justice. None of those things you claim to be. You are a mercenary.
And mercenaries are not lawful combatants and deserve whatever comes their way at the hands of the people they are attacking.
You have no 1st Amendment rights when you’re a mercenary.
Doesn’t matter what side you’re on. Doesn’t matter what cause you’re showing up to disrupt. If you can’t express yourself peacefully through diplomatic means, then you better be prepared to meet your maker at the hands of someone who is only barely keeping their own violent tendencies at bay through a massive exercise of self-control.
I know it sounds romantic to attend these rallies and get shit started with the other side. And when you’re young and passionate, it’s really easy to get whipped up into a frenzy of raw emotions. There is a reason why young people are preferred when it comes to warfare. They are easy to manipulate and control and set off.
But I’m telling you all this right now. You’ve got no idea what road you are starting down. Romance and idealism wears off really fast when you’re laying in a pool of your own blood trying to stuff your intestines back into your torn abdomen.
I’ve been lucky enough to go forty-two years without having to put the skills I learned in the Marines to use. I continue to train and keep those skills up to date because I see the madness that is happening all across this country. I don’t train to attack others like you do. I train to defend others FROM you. I’m not alone either.
There are thousands of men and women in this country who have seen war and death and don’t want any more to do with it. They want to live in peace. They want to forget the things they’ve had to do in the service of their country. They want to raise their kids and have family BBQs and build tree houses and soap box derby cars and have tea parties.
They don’t want this shit that you’re selling.
You have the extremist left and the extremist right that are doing their best to get something started. To force us into a Civil War. Even in the 1860’s, the violence between the North and South was nowhere near what we see today. Nowhere. Even. Close.
And yet we still had a war of ideology that consumed hundreds of thousands of lives.
All you young and naive kids on both sides of this equation who think that having a Civil War will advance your agenda or restore your vision of what you think is America, just remember this… Those of us older generations aren’t having any of this shit. And if you jump off, you better be prepared to deal with US. We don’t care what color you’re wearing or what sign you’re holding if you come after us, our friends, our family, our co-workers, our neighbors, etc., WE will kill you.
So remember that when you’re thinking that it’s just Left vs Right, or Liberal vs Conservative, or Commie vs. Fascist. We are the variable you’re not considering.
That “Silent Majority” that you pretend does not exist is getting really sick and tired of your bullshit.

Geoffrey B. Higginbotham
Major General, USMC (Ret.)

As there's no refutation of the actual guy (age 73, vet of both VN War and Desert Storm) as the source after some weeks in circulation, I suspect he actually wrote it. My only response is "Oohrah!"

Hold The Line

SecDef Mattis was visiting Jordan, and a mixed group of US troops "ambushed" him with an impromptu school circle. Somebody had a cellphone cam handy...

"Well done to you...it's good to see you all out here, young men and women. For those of you who I haven't met, my name's Mattis; I work at the Department of Defense, obviously. Good to see you there...

Thanks for being out here, okay. I know at times you wonder if any of us know. And you get promoted after a while you're so remote that you get out of touch with those of you who matter. But believe me I know you're far from home, every one of you. I know you could all be going to college, you young people, or you could be back on the block...just grateful. The only way this great big experiment that you and I call America is gonna survive is we've got tough hombres like you.

You remember, some of you are too young, Cpl. Long, but on 9/11, we racked up against an enemy that thought if he hurt us, he could scare us. But we don't frickin' scare. That's the bottom line. We'll go out here, we'll fight alongside our friends and allies, and we're gonna keep right on fightin' until they're sick of us, and leave us alone.

You're buying time; you're a great example to our country right now; it's got some problems, you know it, and I know it. It's got problems we don't have in the military.
You just hold the line, my fine young soldiers, sailors, airmen, Marines. You just hold the line, until our country gets back to understanding and respecting each another, and showing it, being friendly to one another, that Americans owe to one another. We're so doggone lucky to be Americans, and we've got two powers. The power of inspiration - and we'll get the power of inspiration back; and we have the power of intimidation, and that's you if someone wants to screw with our families and our country or our allies.

So thanks so much for being out here; you complete took me by surprise, I'm off in Lalaland having a group here...that's good, keep the old guys like me guessing. The only reason I came back - I flunked retirement - the only reason I came back is to serve alongside young people like you who are so selfless, and frankly so rambunctious. It's a pleasure to be around you all.

Take care of each other out here - we call them in the Naval phrase "take care of your shipmates" out here, okay - take care of each other. It can get old, it can get hot, you can get sloppy, and you can get complacent; don't let it happen.

Oorah! Thank you. Thanks all of you. Listen to your NCOs now. So long."
Just spitballing, but I'll bet dollars to donuts that no DoD assbag, service secretary, or SecDef himself in the last 8 years, ever got the kind of spontaneous cheers from anyone when they showed up or left anyplace they went that SecDef Mattis gets just by walking up to a group of bottom-ranking service members.

We've got a navy that can't sail without crashing, a boondoggle airplane that can't fly for shit, and a sack of generals and admirals that aren't worth the bullets it'd take to line 'em up against a wall like they deserve.

But our rank-and-file troops, despite over a decade of grinding and senseless war, and nearly a decade of ruinous social experimentation, is going to be just fine.

You can take that to the bank. God help the fools that dare them to prove it.
Fuckin' A right!

And The Hole Gets Deeper

Longer video of yesterday's story about the nurse arrested by badged thug in Salt Lake City:

So the nurse, charge nurse of the burn unit where a victim unconscious, under no suspicion of any criminal conduct, not under arrest, nor with any cause to be, therefore not covered by any imaginary "exigent circumstances" claims, then or now, told the officer, in absolute compliance with both University Hospital/SLC PD mutually agreed upon policy, and black-letter law of the Supreme Court's explicit decision in McNeely v. Missouri that all non-consensual blood draws absent consent require a search warrant, and was arrested because she told Detective Jackboots Respectmahauthoritay Payne that he was trying to break the law, something which she was prevented by policy, law, ethics, and conscience, from participating to or assenting to.

The arrest was made on direction from Payne's supervisor, Lt. Shitforbrains Tracy, and both jackboots in question working for the Salt Lake City PD.

Any blood draw on the patient would have been illegal, a battery upon the patient, and would have likely cost any medical person participating in same to lose their license to practice.
Detective Jackboots was thus either trying to compel a medical professional to commit battery upon a patient, or look the other way while he did it, neither of which are legal in any state in the union.

There were multiple SLCPD officers present, all of whom were informed multiple times and ways in the act that they were out of policy, and breaking the law.
Battery is a misdemeanor; conspiracy to do so makes this incident a felony by Det. Payne, Lt. Tracy, and any and all officers present and complicit with the action.
The arrest, being illegal (proof of which that no charges were filed) was assault and battery, false arrest, false imprisonment, kidnapping, public endangerment (that nurse had direct supervisorial duties in a critical patient care unit), violation of civil rights under color of authority, and egregious official assholishness above and beyond the call of duty.

So what you watch in the video is multiple SLCPD officers commit half a dozen state and federal felonies and misdemeanors in just the first minute, starting at about the 06:50 mark of his video.

That's before we get into civil claims against Det. Payne, every other officer present who failed to intervene, Lt. Tracy, the Salt Lake City PD, and Salt Lake City itself. who owns these ignorant badged jackasses, and all the mischief, piracy, and brigandry they practice, by the nurse, every patient in that ward the entire shift including the victim of the accident that started this monkeys-fucking-a-football incident, the hospital, and every doctor and nurse on that shift deprived of the services of that nurse for the duration of her illegal arrest and detention.

And then there's mental anguish for the nurse, plus the punitive damages, traditionally treble the actual damages.

If you have any SLC municipal bonds in your portfolio, you'd best dump them, fast.
This is going to be a whopper, and a conga line of lawyers looking to proceed with this case on behalf of the 20-80 plaintiffs will look like Disneyland's front gate on the Fourth of July.

But wait, there's more!

On one of the multiple videos now coming to light in this case, you can hear one of the officers comment that the reason they couldn't get a warrant is because they have no probable cause!!!
So they knew ALL ALONG they were asking for consent/collusion to perform a blatantly unconstitutional and illegal search and battery on an unconscious person, A VICTIM, in front of the hospital staff, God, and everybody!!!

Well played, badged jackbooted thugs of Salt Lake City.
When 5000 lawyers get you in court, they'll get every DUI/DWI arrest/conviction in the last 5 years and every citation in the next 2, thrown out as another unconstitutional illegal search, because that's SLCPD policy!

Every cop there who was in on this is now tainted going back to the statute of limitations, for every case their name is on.

Fucking brilliant, assholes.

And to boot, the Detective Clousseau in question was trained in phlebotomy techniques, so as a forensically-aware detective, it's reasonable to assume he should have known that the blood sample he was demanding was not only out of hospital policy, but expressly prohibited under the decision issued by SCOTUS in 2013, McNeely v. Missouri, over four years prior to this incident.

Some people make fun of how backwards Utah is, but last I looked, they had electricity, running water, postal delivery, and the internet. So not being aware of black-letter law and relevant decisions on his specific area of expertise by Det. Jackboots is recockulous.

This wasn't interference, this wasn't police ignorance, this was explicit indifference to known law, and a blatant attempt to bully a nurse, batter a patient, and break whatever laws he deemed expedient, because badge, gun, and sovereign immunity for stupidity.

That's not just a firing offense, he needs to spend a good long stretch in the federal pen (with his lieutenant, and every officer there), where and when they can spend as much time as they please re-acquainting themselves will the details of the law they were formerly expected to enforce.

Ignorance by The Law is no excuse.
These were, indeed, deliberately law-breaking thugs with an attitude.

Book 'em, Dan-o.

And then sue their asses naked.

So, hey, same day as the national tsunami-$#!^storm broke, guess who's suddenly, 5 weeks later, suddenly on leave, and under criminal investigation?

Salt Lake City police say an officer seen on video dragging a screaming nurse from a hospital and handcuffing her will be put on paid administrative leave after prosecutors called for a criminal investigation.
Police Chief Mike Brown said in a statement Friday that his department will comply with the investigation into Detective Jeff Payne. He arrested nurse Alex Wubbels after she refused to allow blood to be drawn from an unconscious victim, in line with hospital policy.
Salt Lake County's Unified Police Department will run the criminal probe into Payne's actions on July 26, which got widespread attention after Wubbels and her lawyers released the dramatic video Thursday.
Brown and the mayor of Salt Lake City have apologized for the incident and changed their policies to mirror hospital protocols.
———
An Idaho police department is thanking a Utah nurse for stopping a Salt Lake City officer from obtaining a blood sample from one of their reserve officers who was unconscious in a hospital.
Police in the eastern Idaho town of Rigby said Friday that William Gray was severely injured in a Utah crash in July when the semi-truck he was driving for work was hit by another car.
Rigby police said in a statement they didn't know until Thursday that the nurse was arrested after refusing to allow blood to be drawn from Gray.
The department thanked the nurse, Alex Wubbels, and hospital "for standing firm" and protecting the Gray's rights.
So, one step ahead of the mob with torches and pitchforks, the District Attorney in SLC decided to get ahead of this thing in a big way.

Somebody's going to jail, folks.
This guy stepped on his dick and took the whole city with him, and they're piiiiiiiiiiiiiiiiiiiiiiiiiiiiisssssssssssssssssssssssssssssssssssed!
And pretty effing embarrassed.

UPDATE: RTWT.
Hours after Salt Lake City’s mayor and police chief apologized for an officer handcuffing a hospital nurse who refused to take blood from an unconscious patient, Salt Lake County District Attorney Sim Gill announced Friday he wanted a criminal investigation into the episode.
“On the face of the evidence, there is concern that is raised about this officer’s conduct,” Gill said in a Friday interview. “But the whole point of an investigation is to gather the information about this situation.”
Gill said he discussed the situation with Mayor Jackie Biskupski and Chief Mike Brown on Friday morning, and they agreed it would be appropriate to conduct an investigation in the name of ”transparency and institutional accountability.”
City officials said late Friday the Unified Police Department would conduct the criminal probe. Meanwhile, an internal affairs investigation by Salt Lake City police into the officer, Detective Jeff Payne, also is ongoing. Payne was placed on administrative leave Friday afternoon, as was a second unnamed officer connected to the confrontation.
Earlier in the day, Brown and Biskupski called the University Hospital nurse, Alex Wubbels, to apologize. They then held a news conference, saying they were alarmed by what they saw on police body camera footage of the arrest, which took place July 26, and said changes to police blood draw policies and officer training had been made.
The mayor said Thursday was the first time she had seen the officer body camera footage documenting the encounter between Payne and Wubbels. The chief said it was the first time he had seen the video in full. The footage became public Thursday during a news conference held by Wubbels’ attorney, Karra Porter, who said no claim or lawsuit has been filed.
“I am sad at the rift this has caused between law enforcement and the nurses we work so closely with,” Brown said. ”I want to be clear, we take this very seriously.”
“What I saw is completely unacceptable to the values of my administration and of the values of the Salt Lake City Police Department,” added Biskupski. “I extend a personal apology to Ms. Wubbels for what she has been through for simply doing her job.”
Another officer, Denton Harper, who was dispatched to the hospital to assist Payne, wrote in his report that he asked Payne “why he didn’t look into drafting a search warrant for the patient’s blood. Payne told me Logan Police Department said they didn’t have enough probable cause to do so.”
The story also has the detective in question, on his bodycam, stating to his supervisor that in his side job, he would "bring all the transients to this hospital, and take all the good patients elsewhere" in retaliation for refusing to let him break the law there that day.

I think Jackboots better start planning his criminal defense, and saving up his money to pay for groceries after he's fired for cause.

Bug Out Packing Feedback

Any idea can be taken too far. So, not this, please.

Ryan blogged my reply, and his thoughts, because nobody who blogs regularly turns down a ready-made post.

One good turn deserves another.

Ryan posted:
Yesterdays Real World Bug Outs post got a lengthy comment from Aesop that I wanted to discuss. I will post it and my comments will be in italics.

I think we could talk in circles about what the right time amounts are. As I look at my list the initial 15 minute time hack is way longer than I would need to do what is on the list. 5 might be a bit optimistic (where are my darn keys right now, etc all) but I could certainly call it 10. It would be 15 at least with kids.

For the long time I need to think about it a bit more.

I like the list broken down by trip idea. That is neat.

This is where the real world part comes in. We aren't fleeing the zombie apocalypse to go camp in the woods or something. Thus a need for a tent and traps and a bunch of bulk food isn't present. I'll be living on a couch or in a cheap motel eating pizza or microwave food from the grocery store. So I do not need to waste time and space on that stuff. Having some capability, like a BOB makes sense but that time and vehicle space would be much more useful for Great Grandmas rocking chair or something. I suppose the specific event and your plan will ultimately dictate. I can see myself ending up with 2 lists, one for an event during normal times and another or the dreaded zombie apocalypse.

You kind of lost me with the talk of color coding and circling. Pre packing stuff makes sense though. I am pretty much there. Concur about the list. My plan is to firm it up an then do just that.

Pre staging stuff in a risky situation (there is a fire nearby, not quite close enough to evacuate yet, etc) certainly makes sense. Having your normal vehicle loaded to bug out at all times sounds kind of problematic. A full set up ready to go in a dedicated vehicle would be cool if you have one and a relatively secure place to store it.

I concur with this [vehicle kit] and have more or less the same set up in my vehicle.

I am inclined to agree with you [re:kid bags being "too hard"]. The difference is you and I are fairly committed to all of this stuff. Normal folks aren't. So what is an acceptable level of hassle to you is not to them.

I use a small backpack so I can stuff it into my BOB if needed.

This [monthly updating the stuff]is on my to do list.

Scanning photos is a great idea. I will add it to my to do list.

I would probably just ask them [relatives] to hold onto said thumb drive for me.

This kind of thing [small caches] definitely has some cool possibilities. I am certainly a fan of caches.
And back again from me:

1) Concur on the "two lists" idea, one for regular displacement, and another for the never-coming-back Zombie apocalypse.

But...

You're heading to Grandma's house next state over. Or wherever.
Get detoured/traffic hell/vehicle problem/breakdown en route.
Okay for regular list if you're in town.
But if you're stuck in BFEgypt Middle of Nowhere, a tent and such might be a much better idea than sleeping cramped up inside the car.
Just saying, there probably shouldn't be that much difference.
I'm sure you've read Zero's blog, and seen multiple stories of people on ordinary trips who ended up in an accident, stranded, lost, clueless, unprepared, etc.
I think in terms of Gilligan's Island:
"a three hour tour, a three hour tour..."
Except no Ginger or Maryanne.

2) As to the list and color coding:
An example
Item 1, briefcase/backpack and B.O.B. - the red circled "1", in the gun safe
Item 2, maps & comms - the black circled "2" in the hall closet, top shelf
Item 3, weapons & ammo - the green circled "3" in the gun safe
Item 4, water & filters - the blue circled "4" in the garage cabinet
and so on.
Schematic plan of house, what the item is, where it is, etc.
In case you've got help for packing (spouse/gf/older kids/etc.):
"You grab the evens, and I'll grab the odds." etc.
But also because in times of stress, your memory and critical thinking goes to shit.
Having your brains on paper in front of your face saves time.
Easy is smooth, Smooth is fast.
If anyone's location enables them to stage them mostly all together side by side, to minimize where/how far each trip is, good for you.

3) Pre-packing some things is what I was getting at, not leaving the whole vehicle loaded 24/7/forever with everything. Unless you can afford that, and buying a surplus tank or APC.
A pre-packed map case should already be in the car. Fits under the seat in most vehicles. Then all you'd have to grab for an evac is the GPS, radios, phone gear, etc. and batts.
And while you don't need 5 jerry cans of water in the car all the time, putting in a really good Katadyn etc. filter takes up about the space of a flashlight, but gets you water anytime or place if you've got anything wet to filter. And 2.5 gal mil-spec style water jugs are 2 1/2 days of water for 1 person in a space a little bigger than a .50 cal ammo can, and much sturdier than a milk jug.

Just saying, if there's anything that can live just as well in the car as at home, or you have the means to have two of something (can opener, water filter, whatever) then having one in the car already saves you trips, which is time, which could get you out alive, or ahead of the rush, and in much better shape at the other end.

Pack your car like a firefighter packs a truck, or a movie prop guy packs his prop van: take everything you might need that'll fit, because once you get there, you don't know what you'll find, and what you will need. And you never know what's really going to happen to you once you leave the garage.

The car all-the-time kit's another topic/post, but back in the day, I could fit a whole lot of emergency goodness in one laundry-basket sized Rubbermaid tote bin.

I once had a regular driving territory every week that took me from L.A. to the Colorado River and back, including beach/ocean area, oak chaparral, forested mountains in the snow line, and Sonoran desert. And the same for movie work, for years and ongoing, everywhere in SoCal from Santa Barbara to San Diego to Death Valley To Vegas to Salton Sea, on dirt roads, at the beach, in a desert lake bed, and at 7000' in the mountains, many/most times miles from cell reception or anything like civilization. I could leave in sunshine and be sitting in fresh snow, sleet, or freezing rain, same day; or leave in marine layer clouds, and spend the day in 110-degree desert, followed by 60-degree desert night. One winter day I left Furnace Creek in Death Valley (-282 feet el.) at 70 degrees, and spent the day working at sea level above and outside the valley in a wind chill of 26 degrees (40 degrees outside, and 45+MPH winds).

Having "stuff" in the car is the difference between a day trip, and a survival ordeal.

Best regards,
Aesop

Fire And Prosecute Jackbooted Thugs

Welcome to the new daily feature, until Officer Jackboots Payne and Lt. Jackboots Tracy of the Salt Lake City PD get the official heave-ho, and a trip to federal court in the defendants' chairs.

Trust me when I tell you that I can do this for a long, long, long, time...
Welcome to the new normal, Officer Jackboots.

A long, long, loooooooong  time...

Consequences, SLCPD

I've got all day to do this, Officer Jackboots.
See if I know how to leave a mark.

DearJackbooted Thugs: You're Officially Dead To Me

How about this one from Salt Lake City:
ER nurse refuses (per policy agreed upon by hospital and SLC PD) that she's not allowed to draw blood from an unconscious patient unless he gives consent (impossible), or the officer arrests him, or they get a warrant for the draw.

So, instead of making the arrest, or obtaining the requisite warrant, Officer Jackboots arrests the nurse in the ER!
For refusing to break the law, violate hospital policy, do something unethical, and commit both a civil rights violation and an act of battery on the patient.

Story link

God help you jackbooted thugs if you get shot or injured.
I won't.
You're why.

I'll relent on one condition, and it's a package deal:

Drop all charges against this nurse.

Fire the officer(s) who arrested her, for cause, without benefits or pension.

Refer them for prosecution for false arrest, kidnapping, and violation of civil rights.

Demote his/her/their supervisors.

Make your entire department go through mandatory re-training on why this is recockulous.

Revoke all sovereign immunity, so the nurse, hospital, and all patients affected can sue the officer(s) in question, the city, and the SLPD, for whatever exorbitant civil damages multiple juries think are justified and fair. Something in the mid nine figure range looks appropriate based on the video.

Otherwise, you're worse than the criminals you claim to protect us against.

And never, ever, ever, ever, EVER let this happen again.

Barring that response, PDQ, let me be the first to say that when someone shoots you, I'm giving out candy.
When you die, I'll send a note saying I heartily approve.
And I hope you suffer on the way.

You maybe think you have a big team? Wait until you see what a wall of scrubs looks like.
There are 2,000,000 nurses in this country, and that's before we get to doctors, PAs, techs, etc. You're not even in the same league.
You're about to be shat upon, from a great height.

Conclusively Crooked Comey The Clown

Looks like someone who used to run the FBI thought Shrillary was going to win, too.

Things are a wee bit different a year later though.

Link
Two Republican senators say they’ve reviewed evidence that indicates former FBI Director James B. Comey began drafting a statement to announce the closure of the Bureau’s investigation into Hillary Clinton’s use of a private email server months before key witnesses, including the former Democratic presidential candidate, were interviewed.
Sen. Charles E. Grassley and Sen. Lindsey Graham wrote to FBI Director Chris Wray asking for information related to Mr. Comey’s announcement, saying they’ve reviewed partially redacted interview transcripts that indicate Mr. Comey was drafting a statement on the closure of the case months before the July 5, 2016, announcement.
The transcripts cited by the Republican lawmakers indicate that a draft statement about the conclusion of the investigation was being circulated among a select group of FBI officials as early as April 2016. The senators said that was before as many as 17 key witnesses were interviewed by the FBI. Mrs. Clinton was interviewed on July 2.

“Conclusion first, fact-gathering second — that’s no way to run an investigation,” the senators wrote in a letter sent Thursday to Mr. Wray. “The FBI should be held to a higher standard than that, especially in a matter of such great public interest and controversy.”
Um, excuse me, but that's collusion (recall that tarmac meeting between Fat Bill and Comey's boss, AG Lynch, confirmed by federal agents, where backing off was discussed explicitly).
It's also criminal conspiracy.
And obstruction of justice.

IANAL, but last I looked, those last two are actual federal felonies. You could look it up.
Conspiracy - 18 USC 371
Obstruction Of Justice - 18 USC 1503
So when can we expect the announcements of federal indictments of William Jefferson Clinton, Hillary Rodham Clinton, Loretta Bananarepublic Lynch, and James Assclown Comey, under those federal criminal statutes...?

There are still U.S. Attorneys serving in Washington D.C., and Phoenix, right...?

Just wondering.

United States v. Clinton, Clinton, et al has a nice ring to it, and it's not like they've never been to court before to sit at the defendant's table.

And note to Special Prosecutor DNC Court Jester and Chief Inquisitor Robert Mueller:
Your number is coming up soon too.
Ya might want to reel that thing in, fold up your tent, quietly tiptoe off the stage, and enjoy your remaining future years without wearing an orange jumpsuit for the rest of them.

80/20 if this gets any more traction, Lynch and Comey are at the top of the Arkansas Flu list, going forward.

If you want to play Arkansas Flu: Home Version, these embiggen:

Bug Out Packing

Between recent events in the Houston area, and this post by Ryan at his Total Survivalist Blog (formerly Total Survivalist Libertarian Rantfest), the topic of packing to GTFO Of Dodge is floating around. (You should forgive that metaphorical pun.)

Some thoughts:

My bug-out prep would be one for 5 minutes and one for 30 minutes, but with kids, I could see a 15 minute instead of 5 becoming necessary.

It always takes more time to parade the troops.

Anything not important enough to grab and load in 30 minutes isn't vital anyways.
BTW, That's 10 3-minute round trips.

So besides figuring what you're carrying, break down those ten (or whatever, your house may be shorter trips than mine) trips into what you grab with each one, based again on triaging priorities. That way, if things get worse, you still got the most important stuff first.

i.e. Notional trip List

1) Important stuff - briefcase and B.O.B.
2) comms, backups, maps, compass, GPS, etc.
3) Weapons & ammo
4) Water and filters
5) shelter - tent, sleeping bags, etc.
6) medical
7) tools, traps, & gear
8) food
9) more clothes, boots, etc.
10) more food, water, addl. supplies

(And don't forget the carrier(s) for Fido and Fluffy, their food, bowls, leashes, waste management supplies, etc.!)

More trips?
Make a longer list, as appropriate.

Then print it out.
Then put a house plan map, with trip number items color-coded, circled, and pre-packed into appropriate bags/bundles, on the back side.
Then make several two-sided color copies.
Then laminate them, and put them in appropriate places.

Anything not hot/cold/time sensitive, as much as possible, should be pre-staged in the vehicle(s), which saves you needless trips.

(Oh, and it should go without saying, your vehicle(s) should already have a list of items always in them 24/7/365 - tools, spares, flares, fluids, fire ext., first aid kit, etc., and a schematic of where they're stored, and what needs to be checked/replaced, at least twice a year. Just like the .Mil has done with jeeps, trucks, HMMWVs, MRAPs, APCs, and tanks since we stopped using horses. Doing this on the changes back/forth from Daylight Savings Time, which is always a Sunday, gives you winter/summer changeovers, along with swapping out stored batteries, rotating stored food, and changing active batteries in your smoke and CO2 detectors, and checking your household fire extinguisher(s). All of which people have, right? RIGHT?)

Kids bags being "too hard" is a cop out.

If they grow that fast, just put one full set of clothes into the bag once a week with laundry, and swap 'em out. You're gonna wash them and fold 'em anyways, so it ain't that tough. Or even once a month.
So obviously what's really kickin' somebody's butt there is self-discipline.

Excuses are just wallpaper for a pile of crap.

The briefcase idea is always right, going back to the second Bond movie.
Having your passport/IDs, important stuff, emergency cash, and some handy weapons and gadgets in a Get Out Of Dodge case or carryall is Survival 101, going as far back as the WWI precursors to the OSS 100 years ago.

Go over each item on a monthly basis, i.e. one item per month.

E.g., on that list, in February, you'd put fresh road maps, topos, state gazeteers, etc. in your map case, put in fresh stored (NOT kept inside the devices) spare batts for your GPS and handhelds, make sure your personal CEOI (local freqs, buddies' freqs, cellphone, e-mail, and snail mail addys for family, friends, neighbors, important contacts - banks, utilities, credit card companies, insurance agents and companies, emergency resources - Poison control, doctors, hospitals, red cross, state and federal FEMA, and anything else you want/need/think is cool etc. is all up to date and current, laminated, duplicated, etc.

And everything should be in both paper copies, AND a bombproof/waterproof/disasterproof encrypted thumb drive or three. You should have some of those stored/buried/cached offsite in redundantly redundant places, with all your important records archived.

You can also fit more photos than anyone should own on the newer high-cap drives, and save yourself toting cartons of albums of otherwise irreplaceable family pics.

For one example, you can put one or more such drives in one of the cute anodized, o-ring sealed aluminum "pill carrier" tubes (Hint: they don't just hold pills), go to a close relative's house outside your region, unscrew the center latch of an interior door like a closet, get a paddle bit, and put a suitable hole into the jamb. Deposit the tube, put the latch back in place, screw it down on most of the screws, and epoxy in a broken-off dummy screw head for the remaining hole(s), and unless their house burns down or washes away too, it'll be there until you need it, or get old enough to go senile and forget you put it there.

If you have masonry bits and some camo skillz plus a glue gun, you can do this with a brick in a pile, a rock, a tree trunk or stump, a plug/switch box in conduit, or about 1000 other places. The places where you can stash stuff you might want, but don't want to carry are mainly only limited by your imagination.

And the fatter aluminum tubes about 3" long hold 30+ quarter-sized coins. Imagine pre-65 silver, or 1/4 oz. gold Canadian Maple leaf coins, and each one is a stash of $90-9000 US dollars of actual money. Just saying.

If you waited this long before you decided to go, you're a little behind the curve, aren't you?
Houston Rita evacuation, 2005. Which is why last-minute evac for Harvey woulda been mega-stupid. This evac killed 130+ people - before Rita even hit.
A day early is always better than an hour too late. Bring snacks, and a piddle bottle.

Your next mission: Your vehicle is already prepped, and in flawless mechanical condition, right?

Your next mission after that: having four to ten ways (P.A.C.E. Plan - Google it) to get out.

The next mission after that: having someplace - an actual destination, not just "in the hills up thar somewherez" - to actually go to.

(And this, boys and girls, is why we regularly read other people's blogs: they make us think, and none of us are smarter than ALL of us.)
