5th Circuit To Emperor Poopypants: WTF Were You Thinking?

 











So, apparently, it took the 5th U.S. Circuit Court Of Appeals about a New York Minute, to not only pull Mr. Fraudulent's Vaxx Mandate over, but for good measure, they pulled it out of the car, and then stood in a circle clubbing it with batons until it stopped moving.

The 5th Circuit, based in New Orleans, said it was delaying the federal vaccine requirement because of potential “grave statutory and constitutional issues” raised by the plaintiffs.

That all amounts to the polite legalese version of "Ain't no way in hell you can get this lead pig to fly, but watching you try to sell it in open court is going to crack us up hereabouts for years, so go ahead on."

FedGov's got until Monday to smoke enough dope to come up with some half-assed excuse for the mandate, followed by the plaintiffs who sued for the injunction to have another chance to beat this jackassical idea to death in court, and then strangle it with its own umbilical cord. 

Normally, a case like this would start at the bottom in district court. That it went straight to the Circuit Appeals court, which then climbed up on the ring ropes, and jumped on it with both feet like a WWF match, speaks volumes about how solidly the Circuit is opposed to the entire idea in its view of the government's actions and chances of prevailing in the case.

The White House is going to have to strategically stockpile Depends by the metric fuckton, once Gropey Dopey finds out about this, and starts sh*tting his pants all over again.

This is a nice victory now, but what worries me is when the Supine Court gets a hold of it. I can't see Roberts and Co. giving the finger to the First Shi**er. I can hope, though...

We can certainly hope that this is what happens. I will be skeptical until the whole issue is dead, dead, hanged by the neck DEAD, cut down, drawn and quartered, and the remains burned to ashes.
Living in times where the most bizarre conspiracy theories play out in real time about six weeks later, I don't think it's possible to be too paranoid about anything calling itself "reform", especially anything from Fed.Guv, whether it's the dog-n-pony show that calls itself Congress, or any so-called Court of the Judiciary. Call me pessimistic, but I don't see real reform happening until it gets much uglier and major cities burn.

News like this makes me pine for Ronald Reagan all the more.

I am enjoying the entertainment while it lasts. I am easily amused.

The Executive branch is going to simply ignore the Court order.

And how are Court orders enforced? All enforcement capabilities are controlled by the executive branch.

The-Powers-that-Be abandoned "Rule-of-Law" quite some time ago. And if "Pretense-of-Law" proves inconvenient for them, they will abandon that too, and just have their satraps rule by decree.

It isn't going to work out very well for anybody. There are plenty of historical examples from which to learn the most likely pathways.

The circle jerk from the USSC is going to be ironically funny. What the hell is John Roberts gonna write to soften the blow? If the USSC upholds the mandate we'll have open civil disobedience and violence. If he sides with the conservative justices he'll get to write it up, despite his inner socialist. Gonna be hysterically hypocritical I'm sure...

Actually, I expect Sundown Joe to be baffled at whatever this mandate is supposed to be about- he'll probably think that Doctor Lady Whatshername wants the house cleaned by some guy named Manny or something. He'll then demand ice cream and a nap.

Doubt it'll have any real impact... after all we ARE talking about the Regime of Glorious and Harmonious P&PBUH (Plus 10%) Orifice of The (p)Resident, The Dementor-in-Chief, Emperor Poopypants the First, Chief Executive of the Kidsmeller Pursuivant, Good Ole Slo Xi-Den. (TM)

They don't give a flying rat-fuck about no courts as we've seen, and once the vidya of one of them 5th Court fuckers either injecting theyselves with Adrenochrome or some such wild ass shytte that 5 years ago I would have said -could never happen- gets shown to them inflagrante in private, and the shytte'll get reversed faster than you pulling out of a $3 Bangkok Whorehouse once you realize where the other guys are dragging you...

The judge in the United Airlines employees vs Scooter Asshole Kirby of United Airlines case is most likely going to issue a ruling tomorrow (Monday) by the close of business, rumor is that because United has basically been ignoring his TRO (and deleting submitted Title VII accommodation forms from their internal company web site), that he may very well slap them with a permanent TRO to preserve status quo until the case is seen all the way through. Maybe we finally have some sane people throwing wrenches into this BS. Still not holding my breath of course.

It's a nice ruling. Doesn't go anywhere near far enough. It should cover ALL shot mandates.
For now I'll take what I can get. As was stated above; what is SCOTUS going to do?
Unfortunately, I'm pretty sure they will not uphold it.
Then it will be up to us.

Congress has had (checks calendar) over 10 months to pass a mandate (not that it would be legal, but they've had the chance). They haven't. I imagine the Supremes will be seeing this sooner rather than later.

1. The Roberts court will overturn the Fifth Circuit's ruling if it makes the stay permanent.

The Fifth Circuit may have stayed Biden's mandate, but the corporations are still going full steam ahead, mine included.
