This Is An Actual COUP

h/t Peter

The above letter, from The Conservative Treehouse/The Last Refuge , is not a joke, or parody. It's real. It's also jaw-dropping.

IANAL. (Not my fault: I couldn't attend law school; my parents were married to each other.) Despite that fact, *I* could now get federal convictions against Sen. Chuck Schumer, Rep. Nancy Pelosi, Rep. Adam Schiff, and Sen. Mark Warner, as well as against FBI Director Wray, DNI Dan Coats, and Dep. AG Rod Rosenstein.

Conspiracy, insubordination on the parts of the executive branch members, as well as sedition.
18 US Code 371 If two or more persons conspire either to commit any offense against the United States, or to defraud the United States, or any agency thereof in any manner or for any purpose, and one or more of such persons do any act to effect the object of the conspiracy, each shall be fined under this title or imprisoned not more than five years, or both.
18 US Code 1001 (a) Except as otherwise provided in this section, whoever, in any matter within the jurisdiction of the executive, legislative, or judicial branch of the Government of the United States, knowingly and willfully—
(1)
falsifies, conceals, or covers up by any trick, scheme, or device a material fact;
(2)
makes any materially false, fictitious, or fraudulent statement or representation; or
(3)
makes or uses any false writing or document knowing the same to contain any materially false, fictitious, or fraudulent statement or entry;
shall be fined under this title, imprisoned not more than 5 years

The mere act of writing that letter makes the four signatories culpable, prima facie, of conspiring with agents of the executive branch to withhold information from the White House contrary to US law, and for the co-conspirators to deliberately fail to follow the express written instructions of the Chief Executive, individually and collectively.

This letter puts all seven parties to this letter on the hook for ten years in pound-you-in-the-butt federal prison, which conviction a jury would reach in about 5 minutes.

The president, right this minute, could direct the AG to arrest all seven for seditious conspiracy, and have them thrown in jail, and be well within the boundaries of settled black-letter federal law.
Right. This. Minute.

Think about that for a minute.

The two most senior Democrats in each house, together with the opposition ranking members on the congressional select intelligence committees, have admitted in writing to have  previously conspired with the current head of FBI, the deputy AG, and the DNI, to disobey the orders of the Chief Executive, withhold information he directed them to provide, and thus violate actual federal law.

That's a coup, boys and girls.

Not "feels like one".
Not a "soft" coup.

This is an actual conspiracy to usurp the President of the United States.

And these four assholes signed their names to it.

So, what is to be done about that?

If they're not in federal custody by noon today, the Rule of Law is completely dead in this country, and you don't live in a constitutional republic, you live in a banana republic.

Which means it's open season.
In both directions.

Good luck to you all under those ROE.

Members of Congress are complaining that the President ordered MORE information related to an investigation be provided to CONGRESS? Isn't the purpose of an investigation to gather all pertinent information and come to a conclusion based upon that information? Isn't it correct to say that a conclusion based on incomplete information is suspect? Aren't they, in fact, saying that they only wish the investigators to have access to information THEY wish them to have, but not other information which may show the President's innocence? Heads I win, tails you lose?

They're treating it as if Trump in hiding information, when he's doing the exact opposite, he's insisting that all pertinent information be provided, not just that which seems detrimental to him.

And these people were stupid enough to sign their NAMES to this?

I'm sure the news media will be all over this story, unless of course Kim Kardasian has a nip-slip which is much more news worthy.

  2. If Sessions doesn't do anything, it's clear he's one of the sedtionists.

  3. @Jess
    Concur.
I'd give him about 60 seconds to act, and then fire him too.

  4. @Mark D,
    Complaining is just bellyaching.
These @$$holes are conspiring to thwart the express wishes of the President, and doing so with executive branch members in a position to be breaking the law if they do so, and as the letter makes clear, had agreed to do prior to this letter.

So, in one fell swoop, you have them all on record as breaking the law, and being party to a conspiracy to do so.

The law says five years in pound-you-in-the-butt federal prison, just for that.
I didn't even dredge up the statutes on sedition, insubordination, etc.

Trump could point to just that letter, right now, and direct US Marshals to arrest all seven for federal criminal conspiracy, firing the three on the spot.

And with Sessions' recusal, and Rosenstein's firing, Mueller is now open to be fired.
As the head of the FBI with knowledge of it when Shrillary was breaking federal law, his indictment within the week would be a slam dunk too.

Either this snowballs beyond belief in short order, or I'm deadly serious when I say we're living in a thoroughly corrupt banana republic.

And you don't have enough ammunition for that.

  5. I don't see Sessions waking up long enough to pursue charges against them.

  6. The Dims are in deep doodoo if the election in November doesn’t put them in charge of the House and Senate. With the mid terms behind him the President can unleash hell upon Sessions, the Democrats and everyone else who is opposing his lawful, Constitutional agenda.
Wednesday November should be “Absent Jeff” Sessions last day on the job.

  7. Sessions....guess what he will do regarding this epiphany ?

  9. Aesop,
No I " don't have enough ammunition for that"; then again, I don't believe there is such a thing as "enough ammunition". There's "not enough" and "almost enough"
Working on progressing from former to latter.

  10. Aesop,

Just to play devil's advocate: This letter implies that the three in the executive branch 'made verbal assurances' regarding the distribution of information to the members of Congress. It also notes that Director Coats provided a written response which they say noted "his agreement that protecting sources and methods must be a top concern.". This makes sense, as any intelligence official would obviously agree that protecting sources and methods is a legit concern. This letter does NOT, however, say that Coats' response in any way acknowledges the aforementioned 'verbal assurances'. Thus, the signatories are implying that Coats written statement agrees with them, without actually providing prima facie evidence of same.

Therefore Coats, Rosenstein, and Wray should immediately provide their boss(es) any and all correspondence with these four as rebuttal to the implications in this letter. This should be done proactively, prior to any orders from the President to produce said correspondence, because they WORK FOR HIM, and not for these four. Barring that... open season.

  11. Aaaannd NOTHING will happen to ANY of them. We must ALWAYS remember that
things are different when you are a dimocrat. Laws do NOT apply to you, nor do rules. You may do as you please, lie, cheat, murder, steal, conspire, etc etc.
You are free to behave in any manner you choose and nothing will be done to you.
Just ask the clintons, menendez, lois lerner etc etc.

  13. @Wes, I agree. Look at everything that preceded this. What happened? Crickets. @ Aesop I'm on board with you 100%. But realistically, do you believe any significant action will be taken? Like so many other law breaking, Constitution busting things the government has done this too will fade away like the morning fog. Like you, I would love to see them thrown into gen pop at Rikers and their stint there made into a reality TV series. But I don't think that's going to happen.

  14. Several of you may very well be correct, and nothing may happen.

And if that's how it works out, you now know exactly where things stand.
    Banana, meet Republic.

    Let the games begin.

  15. We've been past that point for some time now. Thing is Americans aren't feeling any pain. Life is good for most people in these United States. Nobody seems willing to Risk it all for what needs to be done. It's frustrating. Everything is out in the open now. They aren't even trying to hide their intentions. They are upset that we won't let them Rule us.
When it comes down to it, many Americans simply don’t have the spine or fortitude to stand up and fight, even with liberty on the line. But self-government requires the people to engage and take action. Otherwise, the system begins to run on its own accord, growing ever larger, more powerful and less responsive to those it was meant to serve. Soon the servant becomes the master. Sometimes, we have to stand up and cut the monster back down to size. It’s hard. It’s messy. And sometimes, it’s downright scary. But stand up we must!
I think an ominous question exists that every person capable of rational thought must ask themselves. What kind of country are we leaving to our children and grandchildren? What will you say when they ask what YOU did to stop the tyranny and destruction of our Constitutional Republic?

  16. They signed it so, invoking a little history, separately OR together. Machts nichts to me how they hang.

  17. Sorry, can't arrest sitting members of Congress. Constitution says so.

    Employees are fair game, though.

  18. McChuck - please refer to Article 1, Section 6. ...in all cases, EXCEPT Treason, Felony, and Breach of the Peace...

Felony and Breach of the Peach covers a multitude of sins, do they not?? Also, only covers while Congress is in session.

  19. Oops, typo - should read "Peace". Sorry.

  20. Nice try, McChuck, but sitting members of congress have been getting led away in cuffs for decades.
